By securing a charter or utilizing our Service, you consent to these Terms. Should you not agree with any part of these terms, you should not use the Service.

• Extended charters

Our services are provided depending on availability and weather conditions. Services may be modified or cancelled at our discretion.

3. Booking and Reservations

3.1 Reservation Process

When reserving a charter, you must:

• Be of at least 18 years of age
• Ensure information provided is correct and thorough
• Render the necessary deposit as detailed in the booking confirmation
• Accept these Terms & Conditions

3.2 Reservation Confirmation

A confirmed booking is valid only following payment and our written confirmation. We maintain the right to decline service to any individual at our discretion.

3.3 Charter Availability

Charters depend on the availability of vessels and favorable weather conditions. We strive to accommodate your chosen dates and times whenever feasible.

4. Payment Terms

4.1 Costs

All fees are quoted in € and incorporate any relevant taxes unless specified otherwise. Fees may change with no prior notification.

4.2 Payment Timeline

• Initial Deposit: Half the full charter cost is due at the time of booking
• Remaining Balance: Due 48 hours in advance of the charter departure
• Extra fees (if any): Due upon the charter's completion

4.3 Methods of Payment

We accept major credit cards, bank wire transfers, and certified checks. Transaction processing is secured through encrypted systems.

5. Cancellation and Refund Policy

5.1 Client Cancellations

• Over 72 hours prior to departure: A full refund minus service fees
• Between 24 to 72 hours before departure: A 50% refund
• Less than 24 hours prior to departure: No refund awarded

5.2 Inclement Weather Cancellations

If our captain deems the weather unsafe, we will:

• Offer another booking date free of any additional costs
• Issue a full refund if rescheduling is unviable

5.3 Mechanical Disruptions

In case of mechanical issues with your assigned yacht, we will try to provide an appropriate replacement. If not possible, you will receive a complete reimbursement.

6. Safety and Behavior

6.1 Safety Obligations

All passengers are expected to:

• Obey instructions from the crew
• Utilize provided safety equipment when mandated
• Inform of any health conditions that may impact their security
• Stay within the designated vessel areas

6.2 Forbidden Items

Items prohibited aboard include:

• Glass containers
• Illegal materials
• Weapons of any kind
• Pets (unless previously authorized)

6.3 General Conduct

Conduct by passengers should be courteous. Behavior that endangers safety or disrupts the experience for others may result in the early conclusion of the charter without a refund.

7. Liability and Insurance

7.1 Our Responsibility

We're only liable up to the paid charter amount. We're not accountable for:

• Injuries resulting from passenger carelessness
• Loss or damage to personal belongings
• Indirect or exemplary damages
• Delays due to weather or uncontrollable factors

7.2 Insurance

Comprehensive marine insurance for our fleet and operations is maintained. Passengers need to have their own personal and travel insurance.

7.3 Risk Acceptance

By participating in our charters, you agree there are inherent risks with marine activities and assume personal responsibility for your safety.

8. Modifications and Itinerary Adjustments

Changes to itineraries, routes, or schedules can be made by us based on factors like weather, safety, or operational requirements. We aim to provide suitable alternatives where possible.

9. Force Majeure

We are not liable for postponements, cancellations, or changes in service stemming from events beyond our control, such as:

• Harsh weather conditions
• Natural catastrophes
• Government directives
• Harbor shutdowns
• Vessel malfunctions

10. Privacy and Data Management

Your private information is managed in line with our Privacy Policy. Service use indicates your agreement to the collection and application of your details per our Privacy Policy.

11. Ownership of Content

All material on our website, including text, visuals, symbols, and photos, is secured by copyright and trademark laws. Unauthorized reproduction, distribution, or creation of derivative content is not permitted.

12. Jurisdiction

Applicable laws in Spain dictate the governance of these Terms. Related conflicts will be settled in the courts situated in Barcelona, Spain.
